Grounds for filing divorce
New Jersey statute 2A:34-2 provides that the following are grounds for divorce:
- Adultery
- Desertion for one year or more
- Irreconcilable differences lasting at least six months
- Extreme cruelty, physical or mental
- Separation, defined as living apart for 18 months in different homes
- Habitual drug addiction or drunkenness for a period of at least 12 consecutive months
- Institutionalization for mental illness for at least 24 consecutive months
- Imprisonment for at least 18 consecutive months after marriage
- Deviant sexual conduct
Types of divorce
Divorce can be either contested or uncontested. In an uncontested divorce, the parties agree on all aspects of the dissolution of the marriage, including assets, custody, and child support; the judge merely makes the divorce official. A contested divorce usually involves a lengthy trial and sometimes takes more than two years to resolve.
Child Custody and Visitation
Section 9:2-4 of New Jersey's statutes states that parents of minor children in New Jersey have equal rights. The court will decide between joint custody, sole custody for one parent with visitation rights for the other parent, or some other custody arrangement based on what the court determines is best for the children.
Child Support and Alimony
New Jersey courts use a variety of factors in determining whether to award child support and/or alimony, and how much it will award. Some of the factors included in Section 2A:34-23 include:
- The children's need
- The standard of living, income, and other resources available to both spouses
- The age and health (both physical and emotional) of both parents and children
- The duration of the marriage
- The history of each spouse's financial and non-financial contributions to the children and family
- How the assets and property are distributed in the divorce settlement agreement
- The parental responsibilities of each parent
- Any other factors the court deems relevant
