New Jersey's Largest Product Liability Settlement

As we approach the end of the year - even though 2012 isn't quite over yet - some people and organizations are already putting together their lists of significant events for 2012.

The New Jersey Law Journal does an annual review of the personal injury cases that resulted in the largest recoveries for the injured parties. This year the largest award was $33.9 million for an industrial accident that left a 33 year old machine operator paralyzed and with brain damage.

The man's torso was crushed by a machine in a way that left him unable to breathe; it was 15 minutes before co-workers found him and were able to rescue him. In the meanwhile he suffered from loss of oxygen to his brain. He's now a quadriplegic and can't do the most basic functions including speaking, feeding himself, or even controlling his bodily functions.

The company that made the machine was held liable for not addressing a known defect in the design of the product, and for failing to put in place safety features and appropriate warnings. The manufacturer agreed to a settlement that was approved by the court.

There are many factors that go into determining what should be awarded to someone injured in an industrial accident. First are the actual economic damages - in this case the plaintiff not only lost the ability to work for the rest of his life, but he also will clearly have very high expenses for round the clock care for the rest of his life. Besides the actual economic damages, injured parties can be awarded money for pain and suffering, for "loss of consortium" which means the impact on the relationship with the injured person's spouse, and punitive damages if it was a case where the defendant acted so badly that the court wants to make an example of them.
