Man Gets $1.9 Million Settlement for Slip and Fall at New Jersey Restaurant

A Newton man received a $1.9 million settlement in a personal injury lawsuit resulting from a fall at a Perkins Restaurant in Budd Lake in 2007.

The 32-year-old victim slipped on a patch of ice near a storm drain in an unlit area of the restaurant parking lot, suffering spine and shoulder injuries including multiple disc herniations in his lower back.

The victim underwent spinal fusion surgery and incurred $250,000 in medical expenses. He was left with permanent disabilities and is unable to perform normal daily activities. The settlement was negotiated in a private mediation session with a retired judge just before the case was scheduled to go to trial.

Cold and snowy weather conditions can lead to an increase in slip-and-fall accidents. Residential homeowners are generally not responsible for such accidents on sidewalks outside their homes. However, commercial owners are responsible for defects (including untreated ice) on the sidewalks outside their premises. Under a recent New Jersey Supreme Court decision, an apartment complex is considered a commercial entity but a condominium complex may not be. A housing authority sidewalk may also be considered commercial.

If you experience a slip-and-fall accident, try to take pictures of the site immediately afterward to document the conditions for a potential future lawsuit. This is especially important in the winter, when snow and ice can melt in a matter of hours - or even be removed before you can come back to take pictures. If you're too seriously injured to do this yourself, ask a friend or family member or even a bystander to do this for you. Also try to get statements and contact information from anyone who witnessed the accident, and promptly notify the owner or occupant of the location where you fell.
